AN ORDINANCE AMENDING CHAPTER 30, ZONING REGULATIONS, ARTICLE III, DISTRICTS, SEC 30-70 SINGLE-FAMILY RESIDENTIAL DISTRICT (R-1),SEC 30-71 SINGLE-FAMILY RESIDENTIAL DISTRICT (R-2), SEC 30-72 MULTIPLE-FAMILY RESIDENTIAL DISTRICT (MF-1), SEC. 30-74 BUSINESS AND COMMERICIAL DISTRICT (BC-1), SEC. 30-75 COMMERCIAL AND INDUSTRIAL DISTRICTS (CI-1), DEVELOPMENT REQUIREMENTS TO ADD MINIMUM CORNER LOT OR TRIANGLE LOT SETBACKS, OF THE CODE OF THE TOWN OF PINE HAVEN, WYOMING.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF PINE HAVEN, CROOK COUNTY, WYOMING, IN REGULAR SESSION DULY ASSEMBLED THAT:

Chapter 30 Article III, Districts Section 30-70 (e), Section 30-71 (e), Section 30-72 (d), Section 30-74 (e), and Section 30-75 (e)of the code of the Town of Pine Haven, Wyoming, are hereby amended to include the following:

Sec. 30-70. Single-family residential district (R-1).

(e) Development requirements.

(5) Minimum corner lot or triangle lot setback

a. Frontage street – 30 feet

b. Side street – 30 feet

c. Side property line – 10 feet

d. Rear property line – 10 feet

(6) All new subdivisions for which a preliminary plat has been submitted in 2022 or later shall have corner lots large enough to allow for 30 foot setbacks on both frontage and side streets. Subdivisions for which a preliminary plat was submitted prior to 2022 may petition Planning and Zoning to reduce the side street setback with a variance to 20 feet. 20 feet is the minimum for sidewalk access and corner line of site safety requirements.

Sec. 30-71. Single-family residential district (R-2).

(e) Development requirements.

(5) Minimum corner lot or triangle lot setback

a. Frontage street – 30 feet

b. Side street – 30 feet

c. Side property line – 10 feet

d. Rear property line – 10 feet

d. Rear property line – 10 feet

SECTION 30-77. SEVERABILITY CLAUSE.

Should the courts of this state or of the United States declare any section, provision, paragraph, clause, sentence, phrase or part thereof of this Ordinance invalid or unconstitutional or in conflict with any other section, provision, paragraph, clause, sentence, phrase, or part thereof of this Ordinance, then such decision shall affect only the section, provision, paragraph, clause, sentence, phrase or part thereof declared to be unconstitutional or unauthorized and shall not effect any other part whatsoever of this Ordinance.

SECTION 30-78. REPEALING CLAUSE.

Any and all preceding Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Any and all remaining provisions of said Chapter and Section which are not specifically amended herein, or which are not deemed amended hereby in order to give full effect to this Ordinance, shall remain in full force and effect.

SECTION 30-79 LEGAL STATUS.

Whenever there is a discrepancy between the requirements of these regulations and any other Town regulations, the most restrictive shall apply.

SECTION 30-80. EFFECTIVE DATE.

This Ordinance shall be in full force and effect from and after passage on three readings or an emergency reading and publication according to law.
