AN ORDINANCE AMENDING CHAPTER 10 CEMETERY SEC 10-25(b) CEMETERY PLOT SIZE, SEC. 10-36 SEVERABILITY CLAUSE, SEC 10-37 REPEALING CLAUSE, SEC. 10-38 LEGAL STATUS, SEC 10-39 EFFECTIVE DATE. TO THE CODE OF THE TOWN OF PINE HAVEN, WYOMING.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF PINE HAVEN, CROOK COUNTY, WYOMING, IN REGULAR SESSION DULY ASSEMBLED THAT:

Chapter 10 Article II – Municipal Cemetery, Section 10-25 Purchase of Burial Lots; Applications; Deeds; Prices; Size (b) size and layout of each Plat shall be as follows:

ARTICLE II. - MUNICIPAL CEMETERY

Sec. 10-25. Purchase of Burial Lots; Applications; Deeds; Prices; Size.

(a) Any person desiring to purchase a Plot or Lot in the Pine Haven Cemetery shall make application to the Town of Pine Haven who shall, upon payment to the Town for the price of the Plot or Lot, issue a receipt for such payment and prepare a quitclaim deed, which shall be submitted to the administrative official or his designated representative for approval, after which, such deed shall be signed by the Mayor and attested by the Clerk of the Town of Pine Haven under the seal of the Town. Such deed shall specify that the person to whom it is issued is the owner of the Plot or Lot described therein. The Town Council may limit the number of such Plots or Lots, which shall be owned by any one person at the same time.

(b) The size and layout of each Plot shall be as follows:

Cemetery Plot

Plot size 16 ft long X 4 ft Wide X 6 ft Deep

Headstone Area

3 ft long x 4 ft wide x 6 ft deep

Grave Area

8 ft long x 4 ft wide x 6 ft deep

Walk Way Area

5 ft long x 4 ft wide x 6 ft deep

SECTION 10-36. SEVERABILITY CLAUSE.

Should the courts of this state or of the United States declare any section, provision, paragraph, clause, sentence, phrase or part thereof of this Ordinance invalid or unconstitutional or in conflict with any other section, provision, paragraph, clause, sentence, phrase, or part thereof of this Ordinance, then such decision shall affect only the section, provision, paragraph, clause, sentence, phrase or part thereof declared to be unconstitutional or unauthorized and shall not effect any other part whatsoever of this Ordinance.

SECTION 10-37. REPEALING CLAUSE.

Any and all preceding Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Any and all remaining provisions of said Chapter and Section which are not specifically amended herein, or which are not deemed amended hereby in order to give full effect to this Ordinance, shall remain in full force and effect.

SECTION 10-38. LEGAL STATUS.

Whenever there is a discrepancy between the requirements of these regulations and any other Town regulations, the most restrictive shall apply.

SECTION 10-39. EFFECTIVE DATE.

This Ordinance shall be in full force and effect from and after passage on three readings or an emergency reading and publication according to law.
